ERRORS & OMISSIONS, ASSUMPTION OF RISK, RELEASE OF LIABILITY, WAIVER & INDEMNITY AGREEMENT

1. ACKNOWLEDGEMENT OF RISK

I acknowledge that lawn mower racing and related motorsport activities are inherently dangerous and involve significant risks. Risks include, but are not limited to, collisions, rollovers, loss of control, mechanical failure, engine or fuel fires, flying debris, hot components, rotating machinery, chains, belts and pulleys, contact with barriers or other objects, uneven or slippery surfaces, weather, noise, other participants, spectators, vehicles, delayed emergency response, inadequate or delayed medical treatment, serious bodily injury, permanent disability and death.

2. VOLUNTARY PARTICIPATION

I confirm that my participation is voluntary. I am responsible for determining whether I am physically and mentally capable of participating safely. I will not participate while impaired by alcohol, cannabis, recreational drugs, medication, fatigue, illness or any other condition that could impair safe participation. W.O.O. may refuse, suspend or remove a participant or equipment when an official reasonably considers participation unsafe.

3. RELEASE OF LIABILITY

In consideration of being permitted to participate in or attend a W.O.O. event, I RELEASE, WAIVE, DISCHARGE AND AGREE NOT TO MAKE A CLAIM against Western Ontario Outlaws Lawn Mower Racing, its organizers, directors, officers, officials, race directors, flaggers, marshals, volunteers, members, employees, contractors, landowners, property owners, event hosts, sponsors, promoters, affiliated organizations, agents, representatives, successors and assigns (collectively, the “Released Parties”) from claims, demands, actions, damages, losses, costs and expenses arising from or related to my participation in or presence at an event, to the fullest extent permitted by law. This includes personal injury, illness, disability, death, property damage or loss, economic loss, medical expenses and other related losses.

4. ERRORS & OMISSIONS

I understand that motorsport events require decisions by organizers and officials and that errors or omissions may occur. These may include timing or scoring errors, incorrect starts or finishes, flagging or communication errors, failure to observe an incident, delayed race stoppage, equipment-inspection or technical-inspection errors, incorrect rule interpretation or penalties, weather or track-condition decisions, staging errors, and delays in emergency response. I voluntarily accept these risks and release the Released Parties from liability for such errors or omissions to the fullest extent permitted by law.

5. RACING EQUIPMENT

I am responsible for the condition, construction, maintenance and safe operation of my racing mower, trailer, tools and other equipment. I understand that W.O.O. inspections or approval do not constitute a warranty or guarantee that equipment is safe or free from defects. I remain responsible for complying with all applicable W.O.O. rules and safety requirements.

6. PITS, PADDOCK & OFF-TRACK AREAS

This agreement applies while racing and while I am in pits, paddock or staging areas; loading or unloading equipment; repairing, maintaining or refuelling equipment; attending meetings; practising; volunteering; assisting another participant; or otherwise present at the event grounds. I understand that racing mowers and other vehicles may be moving in these areas.

7. PROPERTY DAMAGE OR LOSS

I understand that my racing mower, vehicle, trailer, tools, personal property and equipment may be damaged, lost or stolen. I accept responsibility for my property and release the Released Parties from liability for such loss or damage to the fullest extent permitted by law.

8. MEDICAL ASSISTANCE

If I am injured or become ill, I authorize event personnel and emergency responders to provide reasonable emergency assistance and arrange medical treatment or transportation when considered necessary. I understand that emergency or medical services may be delayed or unavailable and that I am responsible for my medical expenses except where otherwise covered by applicable insurance.

9. RULES & SAFETY

I agree to follow W.O.O. rules, safety requirements, officials’ instructions, flagging instructions, track procedures, pit procedures and equipment requirements. I understand that failure to comply may result in removal from an event, suspension or other disciplinary action.

10. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from claims, losses, damages, costs and expenses arising from my participation, my acts or omissions, my racing mower or equipment, my violation of event rules, my negligence or misconduct, or claims brought by another person as a result of my actions, to the fullest extent permitted by law.

 11. EVENT CHANGES OR CANCELLATION

I acknowledge that W.O.O. may delay, alter, stop or cancel a race or event, change track configuration or racing procedures, restrict participation, or change the schedule when reasonably considered necessary for safety, weather, track conditions, mechanical concerns or other operational reasons.

12. INSURANCE

I understand that event insurance, if applicable, does not necessarily cover every injury, loss or circumstance. I am responsible for determining whether I have appropriate personal accident, health, property or other insurance coverage.

13. PHOTOGRAPHY & VIDEO

I acknowledge that photographs, video and other recordings may be taken at W.O.O. events. I grant permission for my image, likeness, racing mower and participation to be recorded and used for legitimate club, promotional, advertising, social-media, website and historical purposes without compensation.

14. ACKNOWLEDGEMENT & VOLUNTARY SIGNING

I confirm that I have read this agreement in full, understand that lawn mower racing is dangerous and that serious injury or death may occur, understand the release and indemnity provisions, and have had the opportunity to ask questions before signing. I am signing voluntarily. I understand that I would not be permitted to participate in a W.O.O. event if I did not agree to these terms. Nothing in this agreement is intended to exclude or limit any right or liability that cannot legally be excluded or limited under applicable law.
